The Supreme Court on Monday dismissed a special leave petition filed by the Samajwadi Party challenging the Allahabad High Court verdict that restrained it’s Pilibhit District Party President from filing further pleas on eviction from party’s district office in Pilibhit.
As per the SLP, SP Pilibhit District President Anand Singh Yadav filed a writ petition before the High Court alleging eviction by the Nagar Palika Parishad, Pilibhit, from the party’s district office.
While refusing to entertain the plea, the High Court refrained Yadav from filing writ petitions before it on the same cause of action.
SP moved the Supreme Court on the grounds that it did not endorse the views of Anand Yadav, who filed the writ petition in his personal capacity.
The party prayed for permission to approach the High Court seeking relief against the alleged eviction from its district office.
Appearing for SP, Senior Advocate Siddhartha Dave apprised the Bench of Justice Sandeep Mehta and Justice PB Varale that due to the High Court order, SP wss now restrained from moving the High Court, despite the fact that the premises belonged to the party and they had been duly paying rent for 16 years.
He argued that orders were passed forcibly evicting the petitioner party on November 12, 2020, without any opportunity of hearing the petitioner.
SP wanted to approach the High Court to seek direction to the Chairman, Nagar Palika Parishad, Pilibhit, and the Executive Officer, to decide on the execution of the lease deed in favour of the petitioner, pursuant to the letter of possession dated March 17, 2005, noted Dave.
Before he could continue, the Apex Court suggested the petitioner to approach the High Court for relief and gave permission for the same.
