The Supreme Court on Monday granted bail to three persons accused in the violence that broke out in Uttar Pradesh’s Sambhal district in November 2024 during a court-ordered survey of a mosque, Live Law reported.

A bench of Justices PS Narasimha and R Mahadevan issued the order granting bail to Danish, Faizan and Nazir after taking into account that the investigation into the violence had been completed and a chargesheet filed, ANI reported.

The Supreme Court also noted that the three men had been in jail since 2024, India Today reported.

All three of them had earlier been denied bail by the Allahabad High Court.

The men were among more than 100 persons arrested in connection with the violence that had broken out in Sambhal on November 24 after a group of Muslims objected to a court-ordered survey of the Shahi Jama Masjid in Chandausi town.

A trial court had ordered the survey in a suit claiming that the mosque had been built in 1526 by Mughal ruler Babar on the site of the “centuries-old Shri Hari Har Temple dedicated to Lord Kalki”.

Five persons were killed in the violence during the survey.

Twelve first information reports were filed after the violence in Sambhal and a Special Investigation Team was formed to investigate the matter. Chargesheets have been filed in all cases and proceedings have begun in some.

Danish, Faizan and Nazir had been booked under several sections of the Bharatiya Nyaya Samiti and the Prevention of Damage to Public Property Act, ANI reported. The provisions invoked included those pertaining to rioting with deadly weapons, endangering human life and attempt to murder.

At the hearing on Monday, advocate Suleiman Khan, representing the three men, told the Supreme Court that they had not been named in the initial FIR and that no incriminating evidence was found against them, ANI reported.

The only incriminating material against them was the alleged confessional statement of another individual accused in the case, which would not be admissible as evidence, Khan added.
