The Supreme Court on Monday denied urgent hearing to a suit filed by the State of Tamil Nadu against the Union government seeking release of over Rs 2291 crore under the Samagra Shiksha Scheme (SSS).
The matter was mentioned before the Bench of Justice Prashant Kumar Mishra and Justice Manmohan by Senior Advocate P Wilson.
Appearing for the Tamil Nadu government, the Senior Counsel said the lack of funds was depriving nearly 48 lakh students of the Right to Education. He sought urgent listing on the grounds that the new academic year started on June 3.
On a query from the Court, Senior Advocate Wilson said the Union government did not provide the funds last year. The State filed the suit on May 20, 2025, he added.
The top court of the country observed that there was no urgency to list the matter during the Court’s partial working days.
The Tamil Nadu government filed the original suit Article 131 of the Constitution, alleging that the Union government was withholding funds under SSS over the non-implementation of the National Education Policy 2020 & PM SHRI in the state.
The State sought direction to the Centre to pay a sum of over Rs 2291 crore, which was due under the SSS, along with future interest.
It further sought declaration that the Central government’s action in linking the entitlement to receive funds under SSS to the implementation of NEP 2020 and the PM Shri Schools within the state was illegal, unreasonable, unconstitutional, and arbitrary.
