Supreme Court allows amendment to plea challenging Sonam Wangchuk’s detention after Centre confirms grounds supplied

The Supreme Court has permitted an amendment to the petition filed by Gitanjali Angmo challenging the detention of her husband, Sonam Wangchuk, after the Union Government informed the Court that the grounds for his detention have now been provided. The original plea had alleged that Wangchuk’s detention was unlawful because the authorities had not shared the reasons for it.

During the hearing, Senior Advocate Kapil Sibal, appearing for Angmo, sought permission to revise the petition in order to contest the recently supplied detention grounds. A bench comprising Justices Aravind Kumar and N. V. Anjaria accepted the request and scheduled the matter for further consideration on October 29.

Sibal also requested that Wangchuk be allowed to exchange notes related to his detention with his wife. Solicitor General Tushar Mehta stated that the government had no objection to this, provided it did not lead to new grounds of litigation.

Wangchuk, a Ladakh-based environmental activist, was detained on September 26 in Leh under the National Security Act (NSA) and is currently lodged in Jodhpur Central Jail. The case will now proceed once the amended petition is filed before the Supreme Court.
