A court in Delhi has reprimanded the Delhi Police for conducting sketchy investigation against BJP Minister Kapil Mishra in connection with an FIR filed against him in 2020 over his tweets that the Aam Aadmi Party (AAP) and the Congress party had created a ‘mini Pakistan’ at Shaheen Bagh and that the then Assembly polls would be a contest between ‘India and Pakistan’.
Additional Chief Judicial Magistrate (ACJM) Vaibhav Chaurasia of Rouse Avenue Courts observed on Monday that a diligent endeavour was made by the Court since March last year for evidence qua Mishra’s Twitter handle, ‘but in vain’.
The court noted that on April 8, the report submitted by the Commissioner of Police, Delhi Police, had assured that efforts were being made to obtain a report from Twitter, now X Corp, regarding Mishra’s tweets.
The judge further observed that no one was present on behalf of the investigating agency to follow up on the directions regarding further investigation.
The court said before it could pass any stringent remarks on the casual attitude of the investigating agency, it was constrained to bring to the notice of the Delhi Police Commissioner, the state of affairs and non-adequate explanation on the part of the investigating agency.
If the aid of any other Ministry was required, the Delhi Police was equipped enough and would not be shy to take resort to, it added.
The judge said out of the 10 dates mentioned by the court, he was appending only order-sheets of March 20, 2025; April 8, 2025; and March 4, 2024, wherein the directions for further investigation were laid down by his predecessor, for the kind perusal of the Commissioner of Police, Delhi Police and the Joint Commissioner, Northern Range, for that would suffice.
Noting that the case has been pending since March last year, the court observed that the Delhi Police failed to investigate the matter properly. If there was any impediment, the same should be reported to the Court, it added.
The ACJM directed that a copy of the court order be sent to the Joint Commissioner, Northern Range to do the needful as his office was already well-acquainted with the state of affairs on March 20, 2025, and listed the matter for further hearing on July 7.
