The Delhi High Court has directed the National Institute of Open Schooling (NIOS) to declare the results of Class XII on or before June 17, enabling students to register for the JEE-Mains 2025 counselling, scheduled for June 19.
The single-judge Bench of Justice Vikas Mahajan observed that students put in hard labour for two to four years, or maybe more, while preparing for JEE (Mains). They should not be excluded from consideration in the counselling despite having attained a good percentile and ranking only on the grounds that the results of class XII were not declared on time by the concerned education board.
Noting that the counselling bodies and the Boards conducting class XII exams (both state and national level) should have proper coordination, the High Court directed the counselling body to consider factoring in the aspect of delay in declaration of results as was earlier done by JoSSA, if informed by the Board(s) well in time.
The single-judge Bench passed the interim order in view of the fact that the last date for registration was June 2.
This would give the students a two-day buffer time for registration of counselling with the Joint Admission Council (JAC) on a single day window available on June 19, noted the High Court.
It further directed the Respondent/JAC to permit the petitioners to register themselves for counselling physically on June 2, 2025, with a condition that seat allotment would be made by JAC to the petitioners only if they were able to furnish the result of class XII before the declaration of seat allotment result of First Round.
If class XII results were not declared by NIOS before June 19, the JAC should then again permit the petitioner students to register themselves on a single day window available on June 19 without insisting upon the class XII result, with a condition that seat allotment would be made to the petitioners only if they were able to furnish the result of class XII before the declaration of seat allotment result of round two.
The single-judge Bench clarified that the interim order was passed in the peculiar facts and circumstances of the case and shall not be treated as a precedent. The directions would not create any special equities in favour of the petitioner students, noted the Court and listed the matter for further hearing on July 7.
Five students, who successfully cleared JEE (Mains)-2025 conducted by the National Testing Agency (NTA), had filed petitions in the High Court contending that having secured a qualifying percentile in the JEE (Mains), they were entitled to participate in the counselling, which would be conducted by the Joint Seat Allocation Authority and the Joint Admission Council (JAC) on June 19. However, they were awaiting their Class XII results.
