Delhi High Court issues notice in high-profile pet custody dispute involving MP Mahua Moitra

The Delhi High Court has issued a notice to Member of Parliament Mahua Moitra in a legal appeal filed by Advocate Jai Anant Dehadrai. The appeal challenges a March order from the Saket Court, which directed both parties to refrain from publicizing proceedings related to their ongoing custody dispute over a pet Rottweiler named Henry.

Senior Advocate Sanjoy Ghose, representing Dehadrai, argued that the trial court’s order infringed upon his client’s freedom of speech. He contended that the suit sought only shared custody of the animal and did not request any injunction or restriction on publicity. Ghose cited the case of Ajay Kumar v. Union of India to support his argument that such a gag order could not be sustained.

Justice Manoj Jain, presiding over the matter, observed that the trial court’s direction was not an injunction under Order XXXIX of the Civil Procedure Code but merely a restraint against publicity. The judge suggested that the parties attempt to resolve the matter amicably and questioned why Dehadrai had withdrawn his application if the cited precedent applied directly.

The case has attracted significant attention, highlighting the evolving legal considerations surrounding pet custody disputes in India.
