The Delhi High Court on Thursday rejected a petition filed by Kashmiri separatist leader Shabir Ahmed Shah challenging the denial of bail by a Special NIA court in an alleged case of terror funding.
The order was passed by the Division Bench of Justice Navin Chawla and Justice Shalinder Kaur.
On July 7, 2023, the special NIA court refused to grant bail to Ahmed.
Senior Advocate Colin Gonsalves, appearing for Shah, had earlier submitted that it was a ‘no material case’ and added that a charge sheet has already been filed by the National Investigation Agency (NIA) in the matter.
Filed through Advocates Mugdha and Kamran Khwaja, the plea submitted that there was no mention about Shah in the main and the first supplementary charge sheet filed by NIA, where it was shown that the offences had allegedly occurred as a result of the conspiracy.
Shah sought bail on the grounds of prolonged incarceration, the impossibility of a speedy trial with 400 witnesses to be examined by the prosecution, and the absence of any material against him in the main and first charge sheet filed by NIA.
The central agency alleged that various accused conspired for raising and collecting funds for causing disruption in Kashmir valley and to wage war against the government of India.
NIA arrested Shah in June 2019. He was arrayed as an accused in the second supplementary charge sheet filed on October 4, 2019.
The national agency accused Shah of playing a key role in building a separatist movement in Jammu and Kashmir, receiving money through hawala transactions, paying tribute to family of slain terrorists, and raising funds through LOC trade to fuel subversive and militant activities.
