Delhi HC Grants Major Relief, Restricts Unauthorised Use of Aishwarya Rai’s Name and Photos

The Delhi High Court has ruled in favour of Aishwarya Rai Bachchan, stating that the unauthorized use of her name violates her rights to privacy and dignity. This decision was made during a hearing on Thursday. Justice Tejas Karia has issued an order preventing various entities from misusing Aishwarya’s name, image, and likeness through technological means, including Artificial Intelligence. The court further stated that such misuse not only results in financial harm to Aishwarya but also damages her dignity, reputation, and goodwill.

 

The statement further said that the unapproved use of her identity could potentially lead individuals to mistakenly believe she supports or recommends certain products and services. The court explained that misuse also impacts the right to live with dignity, saying, “Personality rights allow a person to control and protect how their image, name and likeness are used.”

The court has issued an ex parte ad interim injunction in her favour, preventing the defendants, including those unidentified, from utilizing her name Aishwarya Rai Bachchan, the acronym “ARB,” her image, likeness, and other attributes for commercial or personal benefit. This order includes all technologies, such as AI, deepfakes, face morphing, and machine learning, across all media.

 

The court has instructed Google LLC to remove the URLs specified in the lawsuit within three days and to provide subscriber details of the operators in a confidential manner. The Ministry of Electronics and Information Technology has also been directed to block the URLs within one week.

Highlighting her reputation as one of India’s most celebrated actress and brand representatives in India, the court expressed concern that any unauthorized use of her image could diminish her established positive image.

 

Aishwarya had approached the court seeking protection from online platforms that were unlawfully distributing AI-generated pornographic material and misusing her identity. Justice Karia informally suggested an interim order to caution the involved parties.
