
The Delhi High Court has asked a trial court to defer the hearing in a case against Bharatiya Janata Party leader Kapil Mishra for a social media post in 2020 allegedly accusing Opposition parties of creating a “mini Pakistan” in Shaheen Bagh during protests against the Citizenship Amendment Act, The Indian Express reported on Saturday.
In late 2019 and 2020, the locality of Shaheen Bagh in Delhi was the site of a large sit-in protest against the Citizenship Amendment Act.
The case against Mishra, who is now the Delhi law minister, also pertained to a social media post he allegedly wrote stating that there would be an “India vs Pakistan” contest on the “streets of Delhi” during the 2020 Assembly elections in the national capital, Live Law reported.
The trial court was set to hear arguments on the framing of charges in the case on Friday, The Indian Express reported. However, Justice Ravinder Dudeja of the High Court on Thursday directed the trial court to fix the case for hearing after October 13.
Mishra had earlier moved the High Court against the summons issued to him by a magistrate in the 2020 case.
The case was registered for promoting enmity between classes in connection with the elections under Section 125 of the Representation of the People Act. A chargesheet in the matter was filed in November 2023.
On July 5, the Delhi Police had filed a second supplementary chargesheet in the case and a third one on August 1 in the trial court, The Indian Express reported. It also said that its investigation in the matter was complete.
As per the chargesheet, social media platform X had given access to Mishra’s account through a single URL to download and retrieve files, the newspaper reported. A URL, or a Uniform Resource Locator, is a web address that provides a unique, specific location for a particular resource on the internet.
The police had attached the downloaded files with the supplementary chargesheet.
However, Mishra told the High Court that these files were “incomprehensible”.
