Dahisar triple murder case: Court grants bail to driver

The Dindoshi sessions court in Mumbai has granted bail to 34-year-old driver Amar Gupta, who was arrested in connection with a triple murder case registered at MHB Colony police station in May.

The case pertains to a violent street brawl in Dahisar West’s Ganpat Patil Nagar, in which two members of Gupta’s family and a person from the side they were feuding with were killed, as reported by mid-day in its May 19 edition.

Additional Sessions Judge S M Agarkar released Gupta on a personal bond of R50,000, observing that his actions during the fatal clash appeared to have been carried out in self-defence.

According to the police, the fight broke out on May 18 over a long-standing feud. A video of the incident recorded by locals shows multiple people armed with sharp weapons, including knives and sickles.

The police alleged that during the incident, Gupta attacked Amit Shaikh with a knife, contributing to his death. However, Gupta’s lawyer, Advocate Sumit Sharma, argued that the act was one of private defence, as the accused’s father, Ramnaval, and brother, Arvind, were brutally assaulted and killed during the same incident.

Sharma told mid-day, “The court noted that Gupta arrived late at the scene and was seen in a video captured by locals. He called the police control room twice — at 4.57 pm and 4.59 pm — which was also confirmed from call data records, which we submitted to the court. My client acted only to protect his family members.”
“The applicant appears to have acted to protect his family members. The possibility of self-defence cannot be ruled out at this stage,” the court order states.

Judge Agarkar observed that the accused had no prior criminal record and that the investigation was complete and the chargesheet filed.

Under the bail conditions, Gupta must report to the MHB Colony police station on the first Monday of every month, refrain from contacting witnesses, and not leave Maharashtra without police permission. Any violation of these terms could lead to cancellation of his bail.
