The Delhi High Court has denied regular bail to former Aam Aadmi Party (AAP) Councillor Tahir Hussain in connection with the murder of Intelligence Bureau (IB) staffer Ankit Sharma during the 2020 North-East Delhi riots. Justice Neena Bansal Krishna dismissed Hussain’s bail application in FIR 65 of 2020 registered at Dayalpur Police Station, stating, “The bail application is dismissed.”

Hussain had previously filed a similar bail plea in December 2024, which was withdrawn in February 2025 due to subsequent developments, with the liberty to approach the trial court. On March 12, 2025, the trial court had dismissed his bail plea, noting that there was no material change in circumstances to warrant bail. Consequently, Hussain approached the High Court seeking relief.

As of now, Hussain has completed over five years in custody in this case.

The FIR was registered based on a complaint filed by the deceased’s father, who had reported his son missing during the riots. Ankit Sharma’s body was later recovered from a drain and was declared “brought dead” by GTB Hospital. According to the complaint, Ankit had left home around 5 p.m. on the day in question to purchase groceries but did not return. His body was found with multiple sharp and blunt force injuries.

The post-mortem report revealed that Ankit Sharma had sustained 51 injuries caused by sharp-edged weapons and blunt force.

The trial court in 2023 framed charges against Hussain and several others under various sections of the Indian Penal Code, including 147 (rioting), 148 (rioting with deadly weapon), 153A (promoting enmity between different groups), 302 (murder), 365 (kidnapping), 120B (criminal conspiracy), 149 (unlawful assembly), 188 (disobedience to order duly promulgated by public servant), and 153A (promoting enmity between different groups).
