Hyderabad: The Telangana High Court ruled on Tuesday that a revision petition regarding the Medigadda barrage collapse case is indeed maintainable, overturning previous comments made by the district court that were deemed undesirable.
The court instructed the lower court to conduct a legal examination of the revision petition.
This ruling comes in the wake of a private complaint filed by social activist Rajalingamurthy, who alleged negligence related to the Medigadda barrage collapse.
His complaint was dismissed by a magistrate’s court, prompting him to file a revision petition challenging that decision.
However, Rajalingamurthy was tragically murdered on February 19, 2025, raising concerns about the implications of his death on the ongoing legal proceedings.
Justice K Lakshman, presiding over the case, emphasized that the comments made by the district judge during the previous hearings were inappropriate and should be annulled.
The judge noted that dismissing the magistrate’s orders would not benefit the complainant and could mislead public perception.
He pointed out that such remarks suggested a preconceived opinion about the accused, which was inappropriate given that the case was still in its preliminary stages.
The court also clarified that while Rajalingamurthy’s death complicates matters, it does not negate the need for legal scrutiny of the issues raised in his complaint.
The High Court has directed the sessions court to address these matters appropriately, ensuring that justice is served despite the unfortunate circumstances surrounding the complainant’s demise.
